1. The terms used in the Terms of Use shall mean respectively:

Website — the website operating in the domain foodtrade.com.pl based on the terms set out in these Terms of Use and in accordance with the applicable laws.

Website Operator or Operator (hereinafter also referred to as “we”, “us” or “our”) — the entity managing the Website, i.e. Food Trade Sp. z o.o., a company with its seat in Warsaw, ul. Smulikowskiego 6/8, Poland, entered into the Register of Entrepreneurs kept by the District Court in Warsaw, 12th Commercial Division of the National Court Register, under no. KRS 0000801228.

User (hereinafter also referred to as “you” or “your”) — any natural person, legal person or organizational unit without legal personality using the Website.

2. In order to gain access to the Website, it is required to use a device connected to the Internet and equipped with a web browser.

3. The content published on the Website, subject to any expressly stated exceptions, is for information purposes only. Accordingly, the content does not constitute an offer, recommendation or inducement to perform any action with legal effect.

4. The Operator makes every effort to check the correctness, completeness and time validity of the information provided on the Website prior to publication, but makes no representations or warranties of any kind, express or implied, as to its correctness, completeness or time validity.

5. The Website allows users to go directly to other websites or to use features integrated into third-party applications and systems. This does not mean that they are supported or recommended by the Operator. Hyperlinks to other websites are provided on the Website solely for the convenience of Users. The Operator is not responsible for the content of these other websites or the use of these other websites by Users.

Due to the informative nature of the Website, the Operator shall not be liable for any direct, indirect, incidental, intentional or consequential damages, losses, liabilities, expenses or costs that may arise in connection with the use or inability to use the Website or third-party websites or in connection with making a decision on the basis of information contained in the Website or third-party websites.

7. The Operator owns the rights to all material made available on the Website and these are not assignable to Users in connection with use of the Website. Users may only use these materials within the scope of the so-called fair use. In particular, it is not permitted to copy, modify, distribute, transmit or otherwise use this material for commercial purposes without the prior written consent of the Operator.

8. Any advice or other content on the Website is not intended to be targeted at specific individuals or their individual circumstances. They are merely a collection of general information that has been made available in one place for easy retrieval. The Operator is therefore not responsible for their practical application in specific cases.

9. The Operator recommends that you take the appropriate precautions, as the use of electronic services may entail risks, including the possibility of phishing attacks and unauthorized use of your personal data by third parties or the installation of malicious software on your device.

10. Terms of Use are governed by Polish law. Any disputes related to the provision of services in accordance with these Terms of Use shall be settled by decision of the court having jurisdiction over the seat of the Operator. Without prejudice to the generality of the foregoing, any User afforded the consumer protection by applicable laws may use extrajudicial means of dealing with complaints and redress. Should any provisions of these Terms of Use be considered invalid by decision of a court or any other competent authority, the other provisions of these Terms of Use shall remain in full force and effect.

11. In matters not covered herein, the provisions of the Act on Providing Services by Electronic Means, the Civil Code and other relevant legislation shall apply.

12. The Operator reserves the right to amend these Terms of Use. We therefore recommend that you check it frequently for updates. The Terms of Use come into force on August 1, 2022.
